In Montana, considering real property disputes, the prevailing party is usually entitled to attorney's fees. Also, the next time he files, find some attorney that will ask for Rule 11, "Frivolous Abuse of the Law"! It is hard to find an attorney that will utilize Rule 11, but when applied it works. If your club as defendant prevails, the law firm representing plaintiff is responsible for the damages! Ouch! That isn't cricket! Please be advised envoking "Rule 11" may cause a riff at the "club" after court.
No! I'm not an attorney. Yes, I support a bunch of them! Lon
Thank you Lon. We have not shot lead on the property for 12 years. We have had recent surveys by an environmental firm that found no problems. The old shooting field and the new (1964!) have had the soil removed and replaced.
