Shipping an early 1890s Parker Shotgun?

Can this type of shotgun be legally shipped to a buyer in NY &/or MA without going through an FFL dealer in that state?
Shotgun made before 1896.
Thanks!

In NY any shotgun including antiques, modern and muzzle loaders must be shipped to a 01 FFL. All require a background check.

Anything built 1898 or earlier is classified as an antique and can be shipped direct according to ATF regulations. It is always best to verify that the shipping company or post office will accept the shipment from a non FFL holder. UPS and Fed Ex will not. The post office should, but in Nashville I have 3 post offices that accept guns and one that refuses to.

Craig,
I am of the belief that the statue to which you refer states "FFL" not "01
FFL".
I have been trying to locate the complete text of this recent NY Law in my references but have not yet located.
This is what I have found in a SCOPE communication:
"The Act requires that a prospective firearm transferor and transferee process the sale via an FFL, but "does not mandate that FFLs play this processing role." An FFL, who does elect to provide the service, may not charge the parties more than $10 per transaction."

This is not the case in NY. Antiques must go to an FFL and the buyer must go through the state background check. All background checks for all gun and ammo must go through the state background check system.

Bob it is my understanding that a C&R 03 FFL is useless in NY for shipments originating out of NY since a C&R can't do a state background check. The only time a NY resident can use a C&R 03 is if your out of state and complete the transaction in person out of NYS.
Isn't an 01 FFL the only FFL that can do background checks??

Craig, so does this mean that in the State of New York, you cannot order a Muzzleloader rifle from say Bass Pro and have it delivered directly to your home?

No even ML's require a state background check by an FFL in NY and can not be shipped directly to your home. NYS is so anti gun I just shake my head. Our legislature is now trying to enact a 10 day waiting period, required liability insurance for gun owners, and a ban on 50 caliber rifles and ammunition.

You can't even purchase a Ruger .22 auto without a NYS Pistol permit that takes about one year to obtain. Add to that safe storage and transportation regs. The people in power hate the 2nd amendment and guns of all types plus they have liberal judges that uphold all this. It's all just crazy!!

I'm checking out real-estate in South Carolina.

Just ship it. You are ok Federally. Just get a copy of a photo ID.

Craig, other than the warm weather, NH is a great option to live in. No sales or income tax, very liberal gun laws, no permit for concealed carry. And just rated the best state to retire to.

What ever happened to "...shall not be infringed"??

Same kind of recent BS in Mass too.

And now Mass is delaying by months the renewal process of a simple LTC by several months. It happened to me for no good reason al all.
I got on the phone immediately with Jim Wallace, a friend of mine who is Executive Director of GOAL and he said "We're working on it, but it's simple and intentional 'foot dragging' on their part... not much we can do right now but our legal team is on it 24/7."

1. NH, 2. Maine 3. Wyoming, 4. Vermont, 5. Idaho

Please pass the word all over the North East. Virginia is already full (and all the crazy NY and MA refugees who write that they don't mind paying our low taxes and the state should increase them for more services).

Legal—not Legal

Well Brian, if New York State is anything like New Jersey, every gun regardless of vintage must go through an FFL and have a background check. This includes air guns and muzzleloaders. It’s too big a risk to take. If somehow you got caught, you’d end up in an expensive legal battle with criminal repercussions, and most likely they would confiscate all your guns. You might get them back someday, but it would be costly in many ways.

That’s a darn shame! New York…a beautiful state that USED to be nice.
