Endangered Species Act Application

I have been looking at the upcoming Julia's Action and repeatedly see reference to buyers responsibility relating to the ESA.
I have tried to research that "responsibility" without success.
Being a resident of New York State can anyone tell me how this applies to my purchase and receipt of a covered gun from this Auction?

Isn't it regarding the ivory found on some firearms? Not sure what a buyers responsibility would be though. I would speculate its a generic "cya" statement similar to lead based paint warnings auctioneers post when selling old buildings.

You probably should call Julia's. I read the paragraph in the Julia's catalog and can't relate it to the purchase of a firearm with an ivory bead.

I know a guy that bought a Lefever in Julias last auction and they would not ship it into NY because it had ivory beads on it. Better look into it Bob.

It is definitely in reference to any sights, inlays, grips, or any other part of a gun or anything else Julia's auctions that might be made of ivory or any other other product from an endangered species... not limited to elephant ivory. It is the buyers responsibility to be able to PROVE that the parts in question were fitted to the article (guns in our case) well before the animal was put on the endangered species list and trade in those products was banned.

Initially, for a year or two, Julia's would remove them from the gun and not release them to the buyer until such time as the buyer could produce to Julia's the proper documentation.
There was a loud uproar and Julia's policy was changed to the present one.

As I understand it NY is very stringent about this.

Please feel free to give me a call. Julia's has gone to great lengths to make sure we are abiding by the laws in these transactions. The state of NY has foolish/outlandish laws for ivory which don't help any elephants but probably make more jobs for bureaucrats. Same with NJ, CA, and a couple of others.

With regard to the client Brian mentions above, to be clear - it was not a matter of Julia's refusing to ship the gun, it is a matter of following the laws of the state. Julia's doesn't want to get in trouble and we don't want our clients in trouble either.

Richard - I dont believe the ESA has anything to do with Buffalo horn, but I am not an expert on the topic.

The only thing i know for certain is that Julia's has hired expertise in this area and we are following the letter and spirit of the law to protect ourselves and our clients from any future problems in this area.

The main things that are covered by the act are ivory,mother of pearl,and tortise shell items.Several of the guitar collectors in Nashville have been fighting the act because all those items are found on high end guitars.
